very loquacious when talking about one particular family member as you're about to see. at center stage early this morning, the contrasting styles of brothers harbaugh. the older john, in tie and clad suit. and then the younger brother jim in a baseball cap that he almost always wears. and their parents. they do have the father who was the coaching influence in their lives. but the brothers both agree mom was the rock of the family. >> well there's nobody in the family that has more competitive fire than my mother. and she competes like a maniac. she believed in me and john and jonie. she took us to games and shot

baskets with us. and just believed in us. >> nobody would fight for us more than my mom. no matter what the situation was or teach us how to have each other's back. whether it was a scrape in the neighborhood. she made it clear that we were to have each other's back no matter what. that was our mom because she was with us every single day. dad worked a lot. he was around. we were with dad. mom took us to practices but mom was with us all the time. >> that was the most interesting part of the conference because you always here how their dad did this and did that and helped them with their football career. and isn't it always all about mom. and they let that known. we're going to hear from some 49er fans and some other well

bought 49er gear, 49er hats, 49er jerseys they really took part in this. >> reporter: kaepernick was an a student at pitman along with being a star baseball, basketball and football player. stay with us for continuing coverage. the preparty we found in san francisco tonight as businesses there cash in on the niners success. plus a crack down on the road already on the way. the statistics the prompted the blitz. and niner fans overcoming obstacles. one kid who dreams of being an announcer and will watch the game from a hospital. and more on the discovery of a teenager's body found dead. the girl is a middle school student and had only lived in the area for a few months. as john sasaki reports we've also learned of suspicious activity in the park on west texas street early this

morning. the investigative process lasted most of the day at alan whit park. finally at about 11:00 p.m. police announced that was the same person missing from fairfield park. we met a man who said he saw something suspicious. >> a car parking like facing going south with his head lights on with a larger man standing next to his car and i, it just struck me funny all day. >> reporter: police tell me they are following up on that information. they add the girl was found naked but with no obvious signs of trauma. they say she was a young teen. near by residents are concerned

about the park and the rougher crowd that sometimes gathers here. >> i used to take my daughter to this park and now i can't anymore. >> reporter: because of what happened today. >> yeah and there's always a lot of people drinking and stuff here it's not a good park. >> the main park here in town. she was in the open in the parking lot. >> reporter: police are reviewing available surveillance video. but we found two cameras across the street. one that caught nothing and the other wasn't everyone hooked up. john sasaki. police say a woman from oakland may face criminal charges for a false amber alert. the amber alert was issued at 4:30 when the unidentified woman claimed her boyfriend took her 1-year-old daughter. the boyfriend sur --

surrendered a new hours later and that's when police found out there was no little girl. the democratic governor pardoned 128 convicted criminals with a bulk of them coming on christmas eve. compare that to 21 pardons the year before. this winter's flu outbreak has claimed two more lives in the bay area. santa clara county health officials today confirmed two homeless men both 58 years old died of the flu in january. we've learned the victims had been living at an encampment on key street in san jose. some say the homeless are the most vulnerable. >> when the flu hits, when a bad epidemic hits when the noro virus hits people die because they're already compromised. >> the new of flu related deaths is now at 14.

santa clara county is now sending mobile units to offer flu shots to people living on the streets. twitter say it is accounts of about 250,000 users were compromised and that hackers may have gained access to user names, e-mail addresses and other personal information. twitter has now sent out e- mails to those users letting them know that the company had reset their password. >> and bank of america suffered an outage of its online banking system today. b of a is blaming technical issues for the problem. bank of america called the outage inexcusable. a spokesperson says the situation had improved considerably by tonight. today marks the first day of san francisco's ban on public nudity and it sparked a lunchtime protest outside of city hall. >> why are we wasting city

drinking and driving. >> reporter: this audible is slightly different than usual. >> reporter: tonight's message especially urgent. because on football's biggest day, alcohol related car crashes in california shoot up 75%. crashes causing death or injury 41% higher compared to other sundays. aaa tracking the steps says alcohol promotion fuel the party. >> they have a 49er shot, we serve for $3 when they score you can order that. it's fun. >> reporter: fun until it's time to get home. responsible servers know they can be held legally liable if a drunk patron gets an arrest. but-- >> it's hard to tell in an exciting game. because they could be drinking a lot but they're just genuinely excited. but you always error on the side of caution. >> reporter: and officers error

on the side of safety. this woman pulled from the line passed her sobriety test. officers say it's not how many arrests but how many they convince. a cab or driver waiting on the bench are better options. >> you have the lights out here, cars out here, motorcycles out herement we're trying to make a big impression on people that this is a big event and big thing for people not to do. >> here's something for you to take a look add. thank you, have a good evening. >> reporter: on sunday, all over the bay area saturation patrols will be looking for intoxicated drivers after the game. trying to find them before they endanger others. now police also want to remind those hosting house parties they can be held responsible if a drunk guest gets into an accident. so they ask to stop serving alcohol close to the end of the game. deborah villalon.

has 49er fever. even the restaurant chain panda express. more than 70 locations will get free orange chicken for anyone that walks in with their 49er gear. a suicide bomber attacked the u.s. embassy in turkey. he died. the bomber is a known militant. state department officials say the embassy is heavily protected but is also due for an upgrade. in mexico city the death toll from yesterday's explosion at the pemex headquarters rose to 23 today. rescuers are still looking for more possible victims. the head of pemex says it appears it was an accident although the cause has not been determined. and a spokesperson said most of

the damage was too administrative offices. >> back here in the u.s., john kerry was officially sworn in today as secretary of state. kerry's wife and daughter attended the ceremony at the capital today. kerry was overwhelmingly approved for the role with 94 yes votes and only three no votes by his former colleagues in the senate. kerry takes over the postfor hillary clinton. tomorrow is another winter spare the air day. bay area quality officials say the air is expected to be unhealthy. that means burning wood is banned. the problem is the smoke can cause problems for people who have certain health conditions such as asthma or bronchitis. how about today, we had a warm one out there. we had 79 in oakland. 72 in morgan hill. not what you expect for february. temperatures outside upper 60s today. we had 69 in napa, 68 in santa

u.s. stock markets rallied higher today with the dow industrials closing above the 14,000 mark for the first time in five years. the dow gained 149 points nasdaq was up 36. a positive jobs report helped pushed the markets higher. but what does 14,000 really mean? jana katsuyama is live now in san francisco to tell us what this big day on wall street means to the average joe, jana. >> reporter: well julie just one look at the ticker behind me and you can see stock after stock that ended up today. the dow jones is an average of just 35. but for people who are looking at their retirement funds and investments it is a hopeful sign. the markets rise today gave investors a taste of the optimism back in 2007 when the dow surpassed the 14,000 mark

five times. >> i hope it's fantastic news. i hope it's a good sign right. >> reporter: the market rise is lifting spirits, people relieved to finally see their investments grow. after the dow dropped as well as 6,600 in 2009. >> it's a good sign. it's continued to go up so no complaints there. >> we're moving in the right direction and compared to a lot of other countries i think we're in a good position. >> reporter: manufacturing and auto sales are being credited for pushing the dow higher. a job's report shows that while unemployment rose, 157,000 jobs were added in january. >> i think there are definitely a lot of people that are still struggling. but i definitely see signs of movement and see more job openings. >> reporter: professor patricia desho says -- >> the economy has improved

people have more money. what do you do with that money, well you can put it in the bank but you earn like zero interest. >> reporter: but profits don't mean much as the country is still suffering from cut backs. >> the average american is better off. >> reporter: and that certainly rings true for more than 12 million americans who according to the bureau of labor statistics were unemployed last month. reporting live in san francisco, jana katsuyama, ktvu channel 2 muse. business has been very good for san ramon based chevron based on its fourth quarter earnings report. chevron posted more than $7,000 in net income for a three month period. for the year it's profit hit $36 billion. chevron also says its improved the performance of its refinery in richmond although a unit of that refinery has been shut down since a fire last friday. gas prices are going up as

a stunt at a high school football game is prompting an investigation. the video was posted on you tube. we are told that a doj agent leans out of the helicopter and drops a football to his son who is a player on the field. the department of justice says it's an unauthorized use of the

helicopter and taxpayer dollars. a busy block of mission street in san francisco reopened a few minutes ago after the police bomb squad determined a suspicious device there is not a threat. police say they receive add call about 8:45 tonight. it was on mission between 15th and 17th. once on the scene the bomb squad discovered it was a grenade. there will be a super bowl watching party. a big time watching party inside a young boy's room at stanford's lucielle packers hospital. he's a special fan who knows a lot about the niners and a lot about overcoming big challenges. >> you know what i would tell him. >> what would you tell him? >> this is our game, this is our house, and this is our win. >> step into 7-year-old jason

alone. critics though argue the i.d. cards will encourage more illegal immigration. santa cruz police are asking people to be on the look out for a woman who stole a purse from an 80-year-old holocaust survivor. the woman was leaguing with her league when the woman stole her purse. this is a security camera picture from the bowling alley monday afternoon. the thief is described as 5'8" tall, 220 pounds. with shoulder lenght brown hair. last night we told you about pa purse snatcher who's intended victim fought back. 23-year-old miya simmons was taken into custody in connection with a botched theft. the obama administration is proposing a compromise on coverage for birth control.

religious groups have objected to providing birth control. more than $7,000 californians saw their health care go up. anthem blue cross raised it rates on individual policyholders saying it will lose money even with those hikes. consumer watchdog calls the rate hikes unreasonable. the advocacy group is also backing the november ballot initiative that would give the state the power to reject excessive rate increases. an organic compound that has found banned products will include bpa. that means manufacturers will have to posta warning if the
